3 s. 106.07, F.S.; revising reporting
4 requirements applicable to candidates for other
5 than statewide office who qualify with the
6 Department of State; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (a) of subsection (2) of section
12 106.07, Florida Statutes, is amended to read:
13 106.07 Reports; certification and filing.--
14 (2)(a) All reports required of a candidate by this
15 section shall be filed with the officer before whom the
16 candidate is required by law to qualify. All candidates who
17 file with the Department of State shall file the original and
18 one copy of their reports. In addition, a copy of each report
19 for candidates for other than statewide office who qualify
20 with the Department of State shall be filed with the
21 supervisor of elections in each the county any portion of
22 which is within the jurisdiction of the office where the
23 candidate seeks resides. Reports shall be filed not later
24 than 5 p.m. of the day designated; however, any report
25 postmarked by the United States Postal Service no later than
26 midnight of the day designated shall be deemed to have been
27 filed in a timely manner. A certificate of mailing obtained
28 from and dated by the United States Postal Service at the time
29 of mailing, or a receipt from an established courier company,
30 which bears a date on or before the date on which the report
31 is due, shall be proof of mailing in a timely manner. Reports

1 shall contain information of all previously unreported
2 contributions received and expenditures made as of the
3 preceding Friday, except that the report filed on the Friday
4 immediately preceding the election shall contain information
5 of all previously unreported contributions received and
6 expenditures made as of the day preceding that designated due
7 date. All such reports shall be open to public inspection.
8 Section 2. This act shall take effect January 1, 1998.
