1 A bill to be entitled
2 An act relating to Collier County; providing
3 that certain fire districts of the county may
4 be governed by a three-member board; providing
5 for a referendum vote; providing for the form
6 of ballot; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. A fire and rescue district in Collier
11 County, specifically the Big Corkscrew Island Fire Control and
12 Rescue District, the East Naples Fire Control and Rescue
13 District, the Golden Gate Fire Control and Rescue District,
14 the North Naples Fire Control and Rescue District, and the
15 Immokalee Fire Control and Rescue District, may, pursuant to
16 the provisions of s. 191.005(1)(a), Florida Statutes, and this
17 act, be governed by a three-member board if proposed by
18 resolution of the governing board of a district adopted no
19 later than 30 days after the effective date of this act and
20 approved by vote of the electors of the district in a
21 referendum to be held at the same time as the first primary
22 election in 1998. The ballot question shall read:

24 The governing board of the District
25 proposes that the district continue to be
26 governed by a three-member governing board. If
27 approved by the electorate, the governing board
28 will have three members and seats will be
29 open on the 1998 general election ballot. If
30 not approved, the governing board will have
31 five members and seats will be open on the

8 Section 2. If a referendum proposing to keep the
9 governing board at three members is approved by the voters,
10 the candidates who qualified for the fourth and fifth seats on
11 the board shall be refunded any qualifying fees paid, and no
12 vote shall occur for the fourth and fifth seats at the general
13 election. Elections held for the governing board after the
14 1998 general election shall be in accordance with the terms of
15 s. 191.005, Florida Statutes.
16 Section 3. This act shall take effect upon becoming a
17 law.
