11  Senator Myers moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 141, between lines 4 and 5,

15

16  insert:

17         Section 85.  Section 175.355, Florida Statutes, is

18  created to read:

19         175.355  Alternative compliance.--Notwithstanding any

20  other provision of law, a local law plan is in compliance with

21  all applicable benefit provisions of this chapter if the

22  governmental entity sponsoring the plan:

23         (1)  Submits to the division a statement prepared by an

24  enrolled actuary that the actuarial value of the benefits

25  provided through the plan is equivalent to or greater than the

26  actuarial value of the applicable minimum benefits provided in

27  this chapter; or

28         (2)  Offers to its employees who are covered by the

29  plan, as an alternative to the existing benefits contained in

30  the plan, a benefit structure that contains the applicable

31  minimum benefits provided in this chapter. If the employees

 1  covered by the plan are represented by an employee

 2  organization for collective bargaining purposes, the local

 3  government entity is in compliance if it offers the

 4  alternative benefit structure pursuant to this subsection,

 5  regardless of whether the employee organization accepts the

 6  alternative benefit structure.
