11  Senator Dudley moved the following amendment:

13         Senate Amendment 

14         On page 141, lines 1-4, delete those lines

15

16  and insert:

17         185.60  Optional participation.--A municipality may

18  revoke its participation under this chapter by rescinding the

19  legislative act or ordinance that assesses and imposes the

20  taxes authorized in s. 185.08 and by furnishing a certified

21  copy of such legislative act or ordinance to the division.

22  Thereafter, the municipality shall be prohibited from

23  participating under this chapter and shall not be eligible for

24  future premium tax moneys. Premium tax moneys previously

25  received shall continue to be used for the sole and exclusive

26  benefit of police officers, or police officers and

27  firefighters where included, and no amendment, legislative act

28  or ordinance shall be adopted which shall have the effect of

29  reducing the then-vested accrued benefits of the police

30  officers, retirees, or their beneficiaries. The municipality

31  shall continue to furnish an annual report to the division as

 1  provided in s. 185.221. If the municipality subsequently

 2  terminates the defined benefit plan, it must do so in

 3  compliance with the provisions of s. 185.37.
