13         Senate Amendment 

14         On page 72, lines 25-28, delete those lines

15

16  and insert:

17         175.411  Optional participation.--A municipality or

18  special fire control district may revoke its participation

19  under this chapter by rescinding the legislative act,

20  ordinance, or resolution that assesses and imposes the taxes

21  authorized in s. 175.101 and by furnishing a certified copy of

22  such legislative act, ordinance, or resolution to the

23  division. Thereafter, the municipality or special fire control

24  district shall be prohibited from participating under this

25  chapter, and shall not be eligible for future premium tax

26  moneys. Premium tax moneys previously received shall continue

27  to be used for the sole and exclusive benefit of firefighters,

28  or firefighters and police officers where included, and no

29  amendment, legislative act, ordinance, or resolution shall be

30  adopted which shall have the effect of reducing the

31  then-vested accrued benefits of the firefighters, retirees, or

 1  their beneficiaries. The municipality or special fire control

 2  district shall continue to furnish an annual report to the

 3  division as provided in s. 175.261. If the municipality or

 4  special fire control district subsequently terminates the

 5  defined benefit plan, it must do so in compliance with the

 6  provisions of s. 175.381.
