  1                      House Joint Resolution

  2         A joint resolution proposing an amendment to

  3         Section 3 of Article XI of the State

  4         Constitution relating to initiatives.

  6  Be It Resolved by the Legislature of the State of Florida:

  7

  8         That the amendment to Section 3 of Article XI of the

  9  State Constitution set forth below is agreed to and shall be

10  submitted to the electors of Florida for approval or rejection

11  at the general election to be held in November 1998:

12         SECTION 3.  Initiative.--

13         (a)  The power to propose the revision or amendment of

14  any portion or portions of this constitution by initiative is

15  reserved to the people, provided that, any such revision or

16  amendment, except for those limiting the power of government

17  to raise revenue, shall embrace but one subject and matter

18  directly connected therewith.  It may be invoked by filing

19  with the secretary of state a petition containing a copy of

20  the proposed revision or amendment, signed by a number of

21  electors in each of one half of the congressional districts of

22  the state, and of the state as a whole, equal to eight percent

23  of the votes cast in each of such districts respectively and

24  in the state as a whole in the last preceding election in

25  which presidential electors were chosen.

26         (b)  The names and signatures on any initiative

27  petition may be checked using a random-sampling verification

28  method as provided by general law.

29         (c)  A preclearance period for verification of names

30  and signatures on initiatives may be established, provided

31  that period does not exceed 60 days prior to the filing

  1  deadline with the secretary of state for a name-by-name,

  2  signature-by-signature verification or 30 days prior to such

  3  filing deadline for a random-sampling verification.

  4         BE IT FURTHER RESOLVED that in accordance with the

  5  requirements of section 101.161, Florida Statutes, the title

  6  and substance of the amendment proposed herein shall appear on

  7  the ballot as follows:

  8               VERIFICATION OF NAMES AND SIGNATURES

  9                     ON INITIATIVE PETITIONS

10         Proposing an amendment to Section 3 of Article XI of

11  the State Constitution to authorize random-sampling

12  verification of names and signatures on initiative petitions

13  and to also authorize a preclearance period for verification

14  of names and signatures on any initiative petition which

15  depends on whether a name-by-name, signature-by-signature

16  verification or a random-sampling verification is used.
