  1                      A bill to be entitled

  2         An act relating to restrictions on individuals

  3         qualifying for public office; amending s.

  4         99.012, F.S.; requiring a subordinate officer,

  5         deputy sheriff, or police officer, upon

  6         qualifying for public office, to take a leave

  7         of absence without pay during the period in

  8         which such person is a candidate for office,

  9         whether or not the person is required by law to

10         resign; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Subsection (5) of section 99.012, Florida

15  Statutes, is amended to read:

16         99.012  Restrictions on individuals qualifying for

17  public office.--

18         (5)  A person who is a subordinate officer, deputy

19  sheriff, or police officer need not resign pursuant to this

20  section unless the person is seeking to qualify for a public

21  office which is currently held by an officer who has authority

22  to appoint, employ, promote, or otherwise supervise that

23  person and who has qualified as a candidate for reelection to

24  that office. However, upon qualifying, a the subordinate

25  officer, deputy sheriff, or police officer must take a leave

26  of absence without pay during the period in which he or she is

27  a candidate for office, whether or not the subordinate

28  officer, deputy sheriff, or police officer is required to

29  resign under this section.

30         Section 2.  This act shall take effect July 1 of the

31  year in which enacted.
