4 certain records relating to mandatory substance
5 abuse testing of children in connection with
6 specified offenses; providing for future review
7 and repeal; providing a finding of public
8 necessity; providing a contingent effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. All records relating to the mandatory
14 substance abuse testing of children who are charged with or
15 found to have committed offenses that would be misdemeanors or
16 felonies if committed by an adult, or who admit to having
17 committed such misdemeanor offenses to law enforcement
18 officers and receive juvenile civil citations for the
19 offenses, are confidential and exempt from s. 119.07(1),
20 Florida Statutes, and s. 24(a), Art. I of the State
21 Constitution. This exemption is subject to the Open
22 Government Sunset Review Act of 1995 in accordance with s.
23 119.15, Florida Statutes, and shall stand repealed on October
24 2, 2003, unless reviewed and saved from repeal through
25 reenactment by the Legislature.
26 Section 2. The Legislature finds that it is a public
27 necessity that such records be held confidential and exempt
28 from the public records law.
29 Section 3. This act shall take effect on the effective
30 date of House Bill No. , relating to mandatory substance
31 abuse testing of children in connection with certain offenses,

1 or similar legislation enacted during the 1998 Regular Session
