1 A bill to be entitled
2 An act relating to emergency medical services;
3 amending ss. 365.171, 395.1027, F.S.; requiring
4 a local governmental entity that operates a
5 "911" emergency telephone system to enter into
6 an agreement with the regional poison control
7 center; requiring that the agreement include a
8 protocol under which the poison control center
9 is consulted with respect to each emergency
10 call that involves exposure to a toxic
11 substance; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsections (4) and (6) of section 365.171,
16 Florida Statutes, are amended to read:
17 365.171 Emergency telephone number "911."--
18 (4) STATE PLAN.--The division shall develop a
19 statewide emergency telephone number "911" system plan. The
20 plan shall provide for:
21 (a) The establishment of the public agency emergency
22 telephone communications requirements for each entity of local
23 government in the state.
24 (b) A system to meet specific local government
25 requirements. Such system must shall include law enforcement,
26 firefighting, poison control, and emergency medical services
27 and may include other emergency services such as poison
28 control, suicide prevention, and emergency management
29 services.
30 (c) Identification of the mutual aid agreements
31 necessary to obtain an effective "911" system.

1 (d) A funding provision that must which shall identify
2 the cost necessary to implement the "911" system.
3 (e) A firm implementation schedule that must which
4 shall include the installation of the "911" system in a local
5 community within 24 months after the designated agency of the
6 local government gives a firm order to the telephone utility
7 for a "911" system.

9 The division shall be responsible for the implementation and
10 coordination of such plan. The division shall adopt any
11 necessary rules and schedules related to public agencies for
12 implementing and coordinating such plan, pursuant to chapter
13 120. The public agency designated in the plan shall order
14 such system within 6 months after publication date of the plan
15 if the public agency is in receipt of funds appropriated by
16 the Legislature for the implementation and maintenance of the
17 "911" system. Any jurisdiction which has utilized local
18 funding as of July 1, 1976, to begin the implementation of the
19 state plan as set forth in this section shall be eligible for
20 at least a partial reimbursement of its direct cost when, and
21 if, state funds are available for such reimbursement.
22 (6) REGIONAL SYSTEMS.--
23 (a) Nothing in This section does not shall be
24 construed to prohibit or discourage the formation of
25 multijurisdictional or regional systems; and any system
26 established pursuant to this section may include the
27 jurisdiction, or any portion thereof, of more than one public
28 agency.
29 (b) By January 1, 1999, each local governmental entity
30 that operates a "911" system shall enter into a cooperative
31 agreement with the poison control center established under s.

1 395.1027 which covers the geographic area of the particular
2 "911" system. The cooperative agreement must include a
3 protocol under which the poison control center is consulted
4 via a telephone conference call for each call to the "911"
5 system which involves exposure to a toxic substance, as
6 identified by the protocol. The protocol must define toxic
7 substances and shall be developed by the appropriate emergency
8 medical services' medical directors, affected local government
9 representatives, and other appropriate persons based on local
10 needs, in conjunction with the designated poison control
11 center.
12 Section 2. Subsection (2) of section 395.1027, Florida
13 Statutes, is amended, and subsection (4) is added to that
14 section, to read:
15 395.1027 Regional poison control centers.--
16 (2) Each regional poison control center shall provide
17 the following services:
18 (a) Toll-free access by the public for poison
19 information.
20 (b) Case management of poison cases.
21 (c) Professional consultation to health care
22 practitioners and emergency "911" systems.
23 (d) Prevention education to the public.
24 (e) Data collection and reporting.
25 (4) By January 1, 1999, each local governmental entity
26 that operates a "911" system shall enter into a cooperative
27 agreement with the poison control center established under s.
28 395.1027 which covers the geographic area of the particular
29 "911" system. The cooperative agreement must include a
30 protocol under which the poison control center is consulted
31 via a telephone conference call for each call to the "911"

1 system which involves exposure to a toxic substance as
2 identified by the protocol. The protocol must define toxic
3 substances and shall be developed by the appropriate emergency
4 medical services' medical directors, affected local government
5 representatives, and other appropriate persons based on local
6 needs, in conjunction with the designated poison control
7 center.
8 Section 3. This act shall take effect upon becoming a
9 law.

13 Requires each local government that operates a "911"
emergency telephone system and each regional poison
14 control center to enter into a cooperative agreement with
a protocol that defines toxic substances and requires the
15 poison control center to be consulted for each emergency
