1 A bill to be entitled
2 An act relating to poison control; amending s.
3 395.1027, F.S., and creating s. 401.268, F.S.;
4 requiring each basic and advanced life support
5 service and air ambulance service to develop
6 and implement a prehospital emergency dispatch
7 protocol with the appropriate regional poison
8 control center; providing that the regional
9 poison control centers shall assume
10 responsibility and liability for calls
11 transferred in accordance with the protocol;
12 providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (4) is added to section
17 395.1027, Florida Statutes, to read:
18 395.1027 Regional poison control centers.--
19 (4) By October 1, 1999, each regional poison control
20 center shall develop a prehospital emergency dispatch protocol
21 with each licensee defined by s. 401.23(13) in the geographic
22 area covered by the regional poison control center. The
23 prehospital emergency dispatch protocol shall be developed by
24 each licensee's medical director in conjunction with the
25 designated regional poison control center responsible for the
26 geographic area in which the licensee operates. The protocol
27 shall define toxic substances and describe the procedure by
28 which the designated regional poison control center may be
29 consulted by the licensee. If a call is transferred to the
30 designated regional poison control center in accordance with
31 the protocol established under this section and s. 401.268,

1 the designated regional poison control center shall assume
2 responsibility and liability for the call.
3 Section 2. Section 401.268, Florida Statutes, is
4 created to read:
5 401.268 Protocols with regional poison control
6 centers.--By October 1, 1999, each licensee shall implement a
7 prehospital emergency dispatch protocol with the regional
8 poison control center established pursuant to s. 395.1027. The
9 prehospital emergency dispatch protocol shall be developed by
10 the licensee's medical director in conjunction with the
11 designated regional poison control center responsible for the
12 geographic area in which the licensee operates. The protocol
13 shall define toxic substances and describe the procedure by
14 which the designated regional poison control center may be
15 consulted by the licensee. If a call is transferred to the
16 regional poison control center in accordance with the protocol
17 established under this section and s. 395.1027, the regional
18 poison control center shall assume responsibility and
19 liability for the call.
20 Section 3. This act shall take effect July 1, 1998.

22 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
23 Senate Bill 302

25 This committee substitute deletes the requirement that the
appropriate local government and regional poison control
26 center enter cooperative agreements under which a protocol is
established where the poison control center is consulted via a
27 telephone conference call for each call to the "911" system
that involves exposure to a toxic substance. The replacement
28 language requires regional poison control centers and life
support service licensees to develop and implement,
29 respectively, a prehospital emergency dispatch protocol that
defines toxic substances and describes the procedure by which
30 the designated regional poison control center may be consulted
by the life support service licensee.
