2 An act relating to district school board
3 members and school superintendents; amending
4 ss. 230.202, 230.303, and 230.321, F.S.;
5 limiting salary increases for district school
6 board members and school superintendents;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Subsection (2) of section 230.202, Florida
12 Statutes, is amended to read:
13 230.202 District school board members; compensation.--
14 (2) Notwithstanding provisions of chapter 145 or this
15 chapter to the contrary, the annual salaries of district
16 school board members for 1993 and each year thereafter shall
17 be established at the same amounts as those members were paid
18 for fiscal year 1991-1992, adjusted by each annual increase
19 provided for in chapter 145. However, the percentage rate of
20 increase in salary given to district school board members
21 shall not exceed the total annual percentage rate increase
22 given to instructional personnel in the school district. Any
23 salary previously paid to district school board members which
24 was consistent with chapter 145 and this section is hereby
25 ratified and validated.
26 Section 2. Subsection (3) of section 230.303, Florida
27 Statutes, is amended to read:
28 230.303 Superintendent of schools.--
29 (3) Notwithstanding provisions of chapter 145 or this
30 chapter to the contrary, the annual salaries of elected
31 superintendents of schools for 1993 and each year thereafter

1 shall be established at the same amounts as those
2 superintendents were paid for fiscal year 1991-1992, adjusted
3 by each annual increase provided for in chapter 145. However,
4 the percentage rate of increase in salary given to elected
5 superintendents shall not exceed the total annual percentage
6 rate increase given to instructional personnel in the school
7 district. Any salary previously paid to elected
8 superintendents which was consistent with chapter 145 and this
9 section is hereby ratified and validated.
10 Section 3. Subsection (3) of section 230.321, Florida
11 Statutes, is amended to read:
12 230.321 Superintendents employed under Art. IX, State
13 Constitution.--
14 (3) The school board of each such district shall pay
15 to the superintendent of schools a reasonable annual salary.
16 In determining the amount of compensation to be paid, the
17 board shall take into account such factors as:
18 (a) The population of the district;
19 (b) The rate and character of population growth;
20 (c) The size and composition of the student body to be
21 served;
22 (d) The geographic extent of the district;
23 (e) The number and character of the schools to be
24 supervised; and
25 (f) The educational qualifications, professional
26 experience, and age of the candidate for the position of
27 superintendent.

29 When any increase in salary is given to the superintendent,
30 the percentage rate of increase shall not exceed the total

1 annual percentage rate increase given to instructional
2 personnel in the school district for that year.
3 Section 4. This act shall take effect upon becoming a
4 law.

Provides that when any increase in salary is given to a
9 district school board member or superintendent of
schools, the percentage rate of increase shall not exceed
10 the total annual percentage rate increase given to
instructional personnel in the school district for that
11 year.
