17 and insert in lieu thereof: The premium tax provided by this
18 chapter shall in all cases be used in its entirety to fund
19 pension benefits, including extra benefits, for firefighters,
20 or for firefighters and police officers, where included. For
21 the purposes of this chapter, the term "extra benefits" means
22 benefits in addition to or greater than those required of
23 chapter plans as of January 1, 1997. However, local law plans
24 in effect on October 1, 1998, shall be required to comply with
25 the minimum benefit provisions of this chapter only to the
26 extent that additional premium tax revenues become available
27 to incrementally fund the cost of such compliance as provided
28 in s. 175.162(2)(a). For the purposes of this section,
29 "additional premium tax revenues" means premium tax revenue
30 received by a municipality or special fire control district
31 pursuant to s. 175.121, that exceed that amount received for

1 calendar year 1997, less the amount committed to fund current
2 pension benefits. Local law plans created by special act
3 before May 23, 1939, shall be deemed to comply with this
4 chapter.
