19 The premium tax provided by this chapter shall in all cases be
20 used in its entirety to fund pension benefits, including extra
21 benefits, for police officers or for police officers and
22 firefighters, where included. For the purposes of this
23 chapter, the term "extra benefits" means benefits in addition
24 to or greater than those required of chapter plans as of
25 January 1, 1997. However, local law plans in effect on
26 October 1, 1998, shall be required to comply with the minimum
27 benefit provisions of this chapter only to the extent that
28 additional premium tax revenues become available to
29 incrementally fund the cost of such compliance as provided in
30 s. 185.16(2). For the purposes of this section, "additional
31 premium tax revenues" means premium tax revenue received by a

1 municipality pursuant to s. 185.10 that exceed that amount
2 received for calendar year 1997, less the amount committed to
3 fund current pension benefits. Local law plans created by
4 special act before May 23, 1939, shall be deemed to comply
5 with this chapter.
