  1                      A bill to be entitled

  2         An act relating to sexual predator

  3         registration; amending s. 775.21, F.S.;

  4         removing an exception to sexual predator

  5         registration requirements which authorizes the

  6         court to remove the sexual predator designation

  7         upon petition by a sexual predator who has not

  8         been arrested for at least 10 years following

  9         release; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Paragraph (g) of subsection (6) of section

14  775.21, Florida Statutes, 1996 Supplement, as amended by

15  chapter 97-299, Laws of Florida, is amended to read:

16         775.21  The Florida Sexual Predators Act; definitions;

17  legislative findings, purpose, and intent; criteria;

18  designation; registration; community and public notification;

19  immunity; penalties.--

20         (6)  REGISTRATION.--

21         (g)  A sexual predator must maintain registration with

22  the department for the duration of his or her life, unless the

23  sexual predator has had his or her civil rights restored, or

24  has received a full pardon or has had a conviction set aside

25  in a postconviction proceeding for any felony sex offense that

26  met the criteria for the sexual predator designation. However,

27  a sexual predator who has been lawfully released from

28  confinement, supervision, or sanction, whichever is later, for

29  at least 10 years and has not been arrested for any felony or

30  misdemeanor offense since release, may petition the criminal

31  division of the circuit court for the purpose of removing the

  1  sexual predator designation. The court has the discretion to

  2  grant or deny such relief.

  3         Section 2.  This act shall take effect July 1 of the

  4  year in which enacted.
