Florida Senate - 1998 SB 312 By Senators Brown-Waite, Bronson, Cowin, Williams and Horne 10-239-98 1 A bill to be entitled 2 An act relating to water sources; amending s. 3 373.223, F.S.; prescribing matters to be 4 considered in authorizing the transport of 5 ground or surface water; providing an effective 6 date. 7 8 Be It Enacted by the Legislature of the State of Florida: 9 10 Section 1. Subsection (2) of section 373.223, Florida 11 Statutes, is amended to read: 12 373.223 Conditions for a permit.-- 13 (2) The governing board or the department may 14 authorize the holder of a use permit to transport and use 15 ground or surface water beyond overlying land, across county 16 boundaries, or outside the watershed from which it is taken if 17 the governing board or department determines that such 18 transport and use is consistent with the public interest, and 19 no local government shall adopt or enforce any law, ordinance, 20 rule, regulation, or order to the contrary. In evaluating 21 whether the transport of ground or surface water is consistent 22 with the public interest, the governing board or department 23 shall consider: 24 (a) The proximity of the proposed source of water to 25 the area in which it is to be used or applied. 26 (b) Other environmentally, economically, and 27 technically feasible alternatives to the source being 28 proposed, including, but not limited to, desalination, reuse, 29 stormwater, and aquifer storage and recovery. 30 (c) Cumulative impacts due to ground water withdrawal. 31 1 CODING: Words stricken are deletions; words underlined are additions.
