  1                      A bill to be entitled

  2         An act relating to telecommunications; creating

  3         ss. 125.421, 166.047, F.S.; prohibiting a local

  4         government from owning a telecommunications

  5         company or providing telecommunications

  6         services except through a business corporation

  7         subject to all applicable taxes and fees;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 125.421, Florida Statutes is

13  created to read:

14         125.421  Telecommunications companies and services.--A

15  county or other entity of local government may not directly or

16  indirectly, alone or in conjunction with others, own, operate,

17  or control a telecommunications company or provide or resell

18  any telecommunications service that is subject to chapter 364,

19  except through a business corporation organized under the laws

20  of this or another state. Such corporation or service is

21  subject to and is not exempt from the imposition, collection,

22  and remittance of all federal, state, and local taxes and fees

23  applicable to other telecommunications companies or services.

24         Section 2.  Section 166.047, Florida Statutes, is

25  created to read:

26         166.047  Telecommunications companies and services.--A

27  municipality or other entity of local government may not

28  directly or indirectly, alone or in conjunction with others,

29  own, operate, or control a telecommunications company or

30  provide or resell any telecommunications service that is

31  subject to chapter 364, except through a business corporation

  1  organized under the laws of this or another state. Such

  2  corporation or service is subject to and is not exempt from

  3  the imposition, collection, and remittance of all federal,

  4  state, and local taxes and fees applicable to other

  5  telecommunications companies or services.

  6         Section 3.  This act shall take effect October 1, 1997.

10    Prohibits a local government from owning a
      telecommunications company or providing
11    telecommunications services except through a separate
      business corporation that is subject to all applicable
12    taxes and fees.
