3 program; amending s. 381.0056, F.S.; deleting
4 provisions which require Department of
5 Education cooperation with the Department of
6 Health; providing staff requirements for the
7 school health services program; providing for
8 use of funds; providing appropriations;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsections (4) and (8) and paragraph (e)
14 of subsection (6) of section 381.0056, Florida Statutes, are
15 amended to read:
16 381.0056 School health services program.--
17 (4) The Department of Health shall have the
18 responsibility, in cooperation with the Department of
19 Education, to supervise the administration of the school
20 health services program and perform periodic program reviews.
21 However, the principal of each school shall have immediate
22 supervisory authority over the health personnel working in the
23 school.
24 (a) Health personnel shall include a full-time
25 registered nurse trained at no less than the BSN level at each
26 public elementary school and at each public school that
27 includes students at the kindergarten through sixth grade
28 levels.
29 (b) Implementation of the provisions of paragraph (a)
30 shall be subject to the availability of moneys and the
31 limitations established by the General Appropriations Act or

1 chapter 216. Moneys appropriated to fund the provisions of
2 this section shall be used to supplement existing local
3 funding and not to supplant such funding sources. The
4 provisions of paragraph (a) shall not apply to schools
5 receiving funding under the provisions of s. 381.0057, which
6 schools shall not receive moneys appropriated to fund the
7 provisions of this section.
8 (6) A nonpublic school may request to participate in
9 the school health services program. A nonpublic school
10 voluntarily participating in the school health services
11 program shall:
12 (e) Be subject to health service program reviews by
13 the Department of Health and the Department of Education; and
14 (8) The Department of Health, in cooperation with the
15 Department of Education, may adopt rules necessary to
16 implement this section.
17 Section 2. There is hereby appropriated from the
18 General Revenue Fund to the Department of Health for the
19 fiscal year beginning on the effective date of this act the
20 sum of $59,559,950, and thereafter the sum of $59,559,950
21 annually, to fund the provisions of this act, of which
22 $10,332,000 shall be used annually to fund the costs of
23 administering the program and supervising the required
24 personnel.
25 Section 3. This act shall take effect July 1 of the
26 year in which enacted.
