Florida House of Representatives - 1998 HB 3183 By Representative Geller 1 A bill to be entitled 2 An act relating to condominiums; creating the 3 Condominium Study Commission; providing for 4 membership; providing legislative intent; 5 providing for duties; providing for 6 recommendations; providing an appropriation; 7 providing for future repeal; providing an 8 effective date. 9 10 Be It Enacted by the Legislature of the State of Florida: 11 12 Section 1. Condominium Study Commission; appointment 13 of members; duties; recommendations.-- 14 (1) There is hereby created the Condominium Study 15 Commission. The commission shall consist of 15 members. Five 16 members of the commission, at least two of whom are members of 17 the Legislature, shall be appointed by the Speaker of the 18 House of Representatives; five members, at least two of whom 19 are members of the Legislature, shall be appointed by the 20 President of the Senate; and five members who are not members 21 of the Legislature shall be appointed by the Governor. It is 22 the intent of the Legislature that the persons appointed to 23 this study commission represent a cross-section of persons 24 interested in condominium issues. In addition to the 25 appointed members, the director of the Division of Florida 26 Land Sales, Condominiums, and Mobile Homes shall serve as ex 27 officio member of the commission. For administrative 28 purposes, the commission shall be located in the Division of 29 Florida Land Sales, Condominiums, and Mobile Homes of the 30 Department of Business and Professional Regulation. 31 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1998 HB 3183 139-242A-98 1 (2) It shall be the duty of the commission to conduct 2 public hearings throughout the state and to take testimony 3 regarding issues that are of concern with respect to 4 condominiums and to receive recommendations for any change to 5 be made in the condominium law. The issues that the 6 commission shall consider shall include, but not be limited 7 to, continued tension between unit owners and boards of 8 directors, the election process for the board of directors, 9 the effectiveness of the Division of Florida Land Sales, 10 Condominiums, and Mobile Homes in responding to complaints 11 from unit owners, the relationship of rights and 12 responsibilities of unit owners and the board, and the method 13 of enforcement of condominium liens and whether or not the 14 condominium should be able to foreclose condominium liens 15 against individual units. Members of the commission shall 16 receive per diem and travel expenses pursuant to s. 112.061, 17 Florida Statutes, while on official business of the 18 commission. 19 (3) The commission shall report its recommendations 20 and findings to the Governor, the Speaker of the House of 21 Representatives, the President of the Senate, and the minority 22 leaders of the House of Representatives and the Senate on or 23 before February 1, 1999, for the 1999 Regular Session of the 24 Legislature. 25 Section 2. There is hereby appropriated from the 26 Division of Florida Land Sales, Condominiums, and Mobile Homes 27 Trust Fund to the Department of Business and Professional 28 Regulation the sum of $100,000 to carry out the provisions of 29 this act. 30 Section 3.
