1 A bill to be entitled
2 An act relating to persons with disabilities;
3 amending s. 526.141, F.S.; requiring the
4 placement of specified signs at self-service
5 gasoline stations for the purpose of
6 identifying gasoline pumps used to provide
7 services to persons with disabilities;
8 providing requirements for the design and
9 location of such signs; providing a penalty;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Subsection (5) of section 526.141, Florida
15 Statutes, is amended to read:
16 526.141 Self-service gasoline stations; attendants;
17 regulations.--
18 (5)(a) Every full-service gasoline station offering
19 self-service at a lesser cost shall require an attendant
20 employed by the station to dispense gasoline from the
21 self-service portion of the station to any motor vehicle
22 properly displaying an exemption parking permit as provided in
23 s. 316.1958 or s. 320.0848 or a license plate issued pursuant
24 to s. 320.084, s. 320.0842, s. 320.0843, or s. 320.0845 when
25 the person to whom such permit has been issued is the operator
26 of the vehicle and such service is requested. Such stations
27 shall prominently display a decal no larger than 8 square
28 inches on the front of all self-service pumps clearly stating
29 the requirements of this subsection and the penalties
30 applicable to violations of this subsection. Such stations
31 shall prominently display, on or directly adjacent to each

1 gasoline pump that is used to provide requested services to
2 the operator of any motor vehicle properly displaying an
3 exemption permit or license plate specified in this paragraph,
4 a plastic sign which shall identify the gasoline pump or pumps
5 at which an attendant will dispense gasoline to such motor
6 vehicles pursuant to the requirements of this subsection.
7 Each sign shall be clearly visible to occupants of passing
8 vehicular traffic on roadways contiguous to the station, shall
9 be made of plastic, with dimensions of no less than 8 inches
10 in width and 10 inches in height, and shall feature the
11 international symbol of accessibility as the central image of
12 the sign, with an image of a gas pump handle displayed to the
13 right of the symbol of accessibility. The international
14 symbol of accessibility, gas pump image, and border of each
15 sign shall be painted with white, light-reflective paint, and
16 each sign shall have a blue background. The Department of
17 Agriculture and Consumer Services shall enforce these
18 requirements this requirement.
19 (b) Violation of paragraph (a) is a misdemeanor of the
20 second degree, punishable as provided in s. 775.082 or s.
21 775.083.
22 (7) The Insurance Commissioner, under her or his
23 powers, duties, and functions as State Fire Marshal, shall
24 promulgate rules and regulations for the administration and
25 enforcement of this section, except for subsection (5) which
26 shall be administered and enforced by the Department of
27 Agriculture and Consumer Services.
28 Section 2. This act shall take effect upon becoming a
29 law.
