Florida House of Representatives - 1998 HJR 3297 By Representative Andrews 1 House Joint Resolution 2 A joint resolution proposing amendments to 3 Section 4 and Section 5 of Article IX of the 4 State Constitution relating to school districts 5 and superintendents of schools. 6 7 Be It Resolved by the Legislature of the State of Florida: 8 9 That the amendments to Section 4 and Section 5 of 10 Article IX of the State Constitution set forth below are 11 agreed to and shall be submitted to the electors of Florida 12 for approval or rejection at the general election to be held 13 in November 1998: 14 SECTION 4. School districts; school boards.-- 15 (a) Each county shall constitute a school district; 16 provided, two or more contiguous counties, upon vote of the 17 electors of each county pursuant to law, may be combined into 18 one school district. In each school district there shall be a 19 school board composed of five or more members chosen by vote 20 of the electors for appropriately staggered terms of four 21 years, as provided by law. 22 (b) The school board shall operate, control and 23 supervise all free public schools within the school district 24 and determine the rate of school district taxes within the 25 limits prescribed herein. Two or more school districts may 26 operate and finance joint educational programs. 27 (c) The legislature, by general law, may authorize the 28 state board of education to assume control of a school 29 district when schools within the school district or the school 30 district itself is low performing. 31 SECTION 5. He shall be elected at the general 3 election in each year the number of which is a multiple of 4 four for a term of four years; or, when provided by resolution 5 of the district school board, or by special law, approved by 6 vote of the electors, the district school superintendent in 7 any school district shall be employed by the district school 8 board as provided by general law. The resolution or special 9 law may be rescinded or repealed by either procedure after 10 four years. 11 (b) The legislature, by general law, may authorize the 12 state board of education to assume control of a school 13 district by removal of its superintendent of schools when 14 schools within the school district or the school district 15 itself is low performing. 16 BE IT FURTHER RESOLVED that in accordance with the 17 requirements of section 101.161, Florida Statutes, the title 18 and substance of the amendment proposed herein shall appear on 19 the ballot as follows: 20 AUTHORIZING STATE BOARD OF EDUCATION BY GENERAL LAW 21 TO ASSUME CONTROL OF A SCHOOL DISTRICT 22 Providing that the Legislature, by general law, may 23 authorize the State Board of Education to assume control of a 24 school district when schools within the school district or the 25 school district itself is low performing, to include removal 26 of the superintendent of schools. 27 28 29 30 31 2
