2 An act relating to trust funds; creating the
3 Victim and Witness Protection Services
4 Reimbursement Trust Fund within the Florida
5 Violent Crime Council; providing for sources of
6 moneys and purposes; providing for future
7 review and termination or re-creation of the
8 trust fund; providing a contingent effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. The Victim and Witness Protection Services
14 Reimbursement Trust Fund is hereby created, to be administered
15 by the Florida Violent Crime Council. Funds shall be credited
16 to the trust fund as provided in HB .... or similar
17 legislation, to be used for the purposes set forth therein.
18 Section 2. (1) Pursuant to the provisions of Section
19 19(f)(2), Article III of the State Constitution, the Victim
20 and Witness Protection Services Reimbursement Trust Fund
21 shall, unless terminated sooner, be terminated on July 1,
22 2001.
23 (2) Prior to the regular legislative session
24 immediately preceding the date on which the trust fund is
25 scheduled to be terminated, the Florida Violent Crime Council
26 and the Governor shall recommend to the President of the
27 Senate and the Speaker of the House of Representatives whether
28 the trust fund should be allowed to terminate or should be
29 re-created. These recommendations shall be based on a review
30 of the purpose and use of the trust fund and a determination
31 of whether the trust fund will continue to be necessary. A

1 recommendation to re-create the trust fund may include
2 suggested modifications to the purposes, sources of receipts,
3 and allowable expenditures for the trust fund. The Florida
4 Violent Crime Council's recommendation shall be made as a part
5 of its legislative budget request to the Legislature pursuant
6 to section 216.023, Florida Statutes. The Governor's
7 recommendation shall be made as a part of the recommended
8 budget presented to the Legislature pursuant to section
9 216.162, Florida Statutes.
10 (3) If the trust fund is terminated, the Florida
11 Violent Crime Council shall pay any outstanding debts or
12 obligations of the trust fund as soon as practicable and the
13 Comptroller shall close out and remove the trust fund from the
14 various state accounting systems, using generally accepted
15 accounting practices concerning warrants outstanding, assets,
16 and liabilities.
17 Section 3. This act shall take effect July 1, 1997, if
18 HB .... or similar legislation is adopted in the same
19 legislative session or an extension thereof.
