1 A bill to be entitled
2 An act relating to beverage taxes; amending s.
3 1, ch. 97-213, Laws of Florida, which provides
4 that the surcharge on the sale of alcoholic
5 beverages for consumption on the premises shall
6 be repealed if certain collections under the
7 beverage laws exceed a specified amount in
8 1998; providing that taxes and benefits
9 generated by the restaurant industry from
10 employment of WAGES program participants shall
11 be included in those collections; providing an
12 effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. Section 1 of chapter 97-213, Laws of
17 Florida, is amended to read:
18 Section 1. No later than March 1, 1999, the Department
19 of Business and Professional Regulation shall certify to the
20 President of the Senate and the Speaker of the House of
21 Representatives the amount of taxes due and paid during
22 calendar year 1998 under sections 563.05, 564.06, and 565.12,
23 Florida Statutes, and payments made to the state pursuant to
24 section 561.54, Florida Statutes, and the amount of taxes and
25 economic benefit generated by the restaurant industry from the
26 employment of participants in the WAGES program. If this
27 amount is greater than $535 million, then, effective July 1,
28 1999, section 561.501, Florida Statutes, is repealed.
29 Section 2. This act shall take effect upon becoming a
30 law.

Revises provisions which provide that the surcharge on

provide that taxes and benefits generated by the
