4 membership of school advisory councils;
5 providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Paragraph (a) of subsection (1) of section
10 229.58, Florida Statutes, is amended to read:
11 229.58 District and school advisory councils.--
12 (1) ESTABLISHMENT.--
13 (a) The school board shall establish an advisory
14 council for each school in the district, and shall develop
15 procedures for the election and appointment of advisory
16 council members. A majority of the members of each school
17 advisory council must be persons who are not employed by the
18 school board at that school. Each advisory council shall be
19 composed of the principal and an appropriately balanced number
20 of teachers, education support employees, students, parents,
21 and other business and community citizens who are
22 representative of the ethnic, racial, and economic community
23 served by the school, provided that vocational-technical
24 center and high school advisory councils shall include
25 students, and middle and junior high school advisory councils
26 may include students. Council members representing teachers,
27 education support employees, students, and parents shall be
28 elected by their respective peer groups at the school in a
29 fair and equitable manner as follows:

6 The school board shall establish procedures for use by schools
7 in selecting business and community members. Such procedures
8 shall include means of ensuring wide notice of vacancies and
9 for taking input on possible members from local business,
10 chambers of commerce, community and civic organizations and
11 groups, and the public at large. The school board shall review
12 the membership composition of each advisory council. Should
13 the school board determine that the membership elected by the
14 school is not representative of the ethnic, racial, and
15 economic community served by the school, the board shall
16 appoint additional members to achieve proper representation.
17 Although schools should be strongly encouraged to establish
18 school advisory councils, any school district that has a
19 student population of 10,000 or fewer may establish a district
20 advisory council which shall include at least one duly elected
21 teacher from each school in the district. For the purposes of
22 school advisory councils and district advisory councils, the
23 term "teacher" shall include classroom teachers, certified
24 student services personnel, and media specialists. For
25 purposes of this paragraph, "education support employee" means
26 any person employed by a school who is not defined as
27 instructional or administrative personnel pursuant to s.
28 228.041 and whose duties require 20 or more hours in each
29 normal working week.
30 Section 2. This act shall take effect July 1 of the
31 year in which enacted.
