11  Senator Kurth moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 9, between lines 6 and 7,

15

16  insert:

17         Section 4.  Subsection (5) of section 985.41, Florida

18  Statutes, is amended to read:

19         985.41  Siting of facilities; study; criteria.--

20         (5)  When the department or a contracted provider

21  proposes a site for a juvenile justice state facility, the

22  department or provider it shall request that the local

23  government having jurisdiction over such proposed site

24  determine whether or not the proposed site is appropriate for

25  public use under in compliance with local government

26  comprehensive plans, local land use ordinances, local zoning

27  ordinances or regulations, and other local ordinances in

28  effect at the time of such request.  If no such determination

29  is made within 90 days after the request, it shall be presumed

30  that the proposed site is in compliance with such plans,

31  ordinances, or regulations.
