1 A bill to be entitled
2 An act relating to alcoholic beverages and
3 tobacco; amending s. 210.10, F.S.; correcting a
4 cross reference with respect to the powers and
5 duties of the Division of Alcoholic Beverages
6 and Tobacco; amending s. 562.45, F.S.; revising
7 obsolete language with respect to penalties for
8 violating the Beverage Law; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (2) of section 210.10, Florida
14 Statutes, is amended to read:
15 210.10 General powers of the Division of Alcoholic
16 Beverages and Tobacco.--
17 (2) The division and all officers and employees under
18 this part shall, in the administration thereof and in the
19 administration of the State Beverage Law, have all the
20 authority and power vested in officers and employees of the
21 division as provided by s. 20.165 s. 561.07, and such power
22 and authority is hereby conferred upon the division and all
23 officers and employees under this part with respect to the
24 administration of this part and also with respect to the
25 administration of the Beverage Law.
26 Section 2. Subsection (1) of section 562.45, Florida
27 Statutes, is amended to read:
28 562.45 Penalties for violating Beverage Law; local
29 ordinances; prohibiting regulation of certain activities or
30 business transactions; requiring nondiscriminatory treatment;
31 providing exceptions.--

1 (1) Any person willfully and knowingly making any
2 false entries in any records required under the Beverage Law
3 or willfully violating any of the provisions of the Beverage
4 Law, concerning the excise tax herein provided for commits
5 shall be guilty of a felony of the third degree, punishable as
6 provided in s. 775.082, s. 775.083, or s. 775.084. It is
7 unlawful for any person to violate any provision of the
8 Beverage Law, and any person who violates any provision of the
9 Beverage Law for which no penalty has been provided commits
10 shall be guilty of a misdemeanor of the second degree,
11 punishable as provided in s. 775.082 or s. 775.083; provided,
12 that any person who shall have been convicted of a violation
13 of any provision of the Beverage Law and shall thereafter be
14 convicted of a further violation of the Beverage Law, shall,
15 upon conviction of said further offense, be guilty of a felony
16 of the third degree, punishable as provided in s. 775.082, s.
17 775.083, or s. 775.084.
18 Section 3. This act shall take effect upon becoming a
19 law.
