17 Section 41. Subsection (17) is added to section
18 489.103, Florida Statutes, to read:
19 489.103 Exemptions.--This part does not apply to:
20 (17) Contracting for repair, maintenance, remodeling,
21 or improvement by any person licensed under part I of chapter
22 475 while acting as the owner's agent pursuant to that
23 license, where all work requiring a contractor is performed by
24 a contractor who has a current, valid certificate or
25 registration issued under this part to perform such work, and
26 where the aggregate contract for labor, materials, and all
27 other items is less than $5,000; however, this exemption does
28 not apply:
29 (a) If the repair, maintenance, remodeling, or
30 improvement is a part of a larger or major operation, whether
31 undertaken by the same or a different contractor, or in which

1 a division of the operation is made in contracts of amounts
2 less than $5,000 for the purpose of evading this part or
3 otherwise.
4 (b) To a person who advertises that he or she is
5 qualified to engage in contracting.
6 Section 42. Subsection (17) is added to section
7 489.503, Florida Statutes, to read:
8 489.503 Exemptions.--This part does not apply to:
