17 Section 1. Paragraph (c) of subsection (2) of section
18 215.32, Florida Statutes, is amended to read:
19 215.32 State funds; segregation.--
20 (2) The source and use of each of these funds shall be
21 as follows:
22 (c)1. The amount of moneys in the General Revenue Fund
23 shall be determined at the beginning of the fiscal year based
24 on the Revenue Estimating Conference's estimate of funds
25 available. This amount shall be adjusted upon determination
26 of the previous year's appropriations which remain unspent
27 after certifications are completed pursuant to s. 216.301.
28 2. The Working Capital Fund shall consist of an
29 amount, not more than 10 percent of the amount of net revenue
30 of the General Revenue Fund for the preceding fiscal year,
31 which accrues from moneys in the General Revenue Fund which

1 are in excess of the amount needed to meet the General Revenue
2 Fund appropriations acts. The Legislature shall have as a goal
3 that the Working Capital Fund for fiscal year 1994-1995 have
4 not less than 2 percent of the amount of net revenue of the
5 General Revenue Fund for the preceding fiscal year, that the
6 Working Capital Fund for fiscal year 1995-1996 have not less
7 than 3 percent of the amount of net revenue of the General
8 Revenue Fund for the preceding fiscal year, that the Working
9 Capital Fund for fiscal year 1996-1997 have not less than 4
10 percent of the amount of net revenue of the General Revenue
11 Fund for the preceding fiscal year, and that the Working
12 Capital Fund for fiscal year 1997-1998 and each fiscal year
13 thereafter have not less than 5 percent of the amount of net
14 revenue of the General Revenue Fund for the preceding fiscal
15 year. By September 15 of each year, the Executive Office of
16 the Governor shall transfer the excess funds that are in the
17 General Revenue Fund to the Working Capital Fund. Whenever the
18 Governor determines that revenue collections in the General
19 Revenue Fund will be insufficient to meet General Revenue Fund
20 appropriations, he or she shall certify the amount of the
21 deficit and transfer up to the amount specified in the General
22 Appropriations Act from the Working Capital Fund to the
23 General Revenue Fund pursuant to s. 216.221. When not required
24 to meet General Revenue Fund appropriations, such moneys shall
25 be used as a revolving fund for transfers as provided by s.
26 215.18; and when the Comptroller determines that such moneys
27 are not needed for either type of transfer, they may be
28 temporarily invested as provided in s. 18.125.
29 3. The provisions of subparagraph 1. notwithstanding,
30 the Comptroller shall pay from the Working Capital Fund such
31 claims as are authorized pursuant to s. 265.55.

1 4.a. The provisions of this subparagraph apply,
2 notwithstanding any other provision of law including, but not
3 limited to, s. 216.351.
4 b. When the Commissioner of Agriculture declares an
5 agricultural emergency pursuant to s. 570.07 and when funds
6 were not specifically appropriated for responding to the
7 agricultural emergency or when funds specifically appropriated
8 for responding to the agricultural emergency are insufficient
9 to eliminate the agricultural emergency, funds shall be
10 transferred from the Working Capital Fund to the Agricultural
11 Emergency Eradication Trust Fund pursuant to s. 570.191 in an
12 amount determined by the Administration Commission. The
13 Administration Commission shall direct the Executive Office of
14 Governor to establish the appropriate spending authority
15 within the Department of Agriculture and Consumer Services and
16 the Comptroller shall transfer the funds to the Agricultural
17 Emergency Eradication Trust Fund. Likewise, if fund balances
18 exist in the Agricultural Emergency Eradication Trust Fund,
19 the Administration Commission shall direct the Executive
20 Office of the Governor to establish spending authority as
21 requested by the Department of Agriculture and Consumer
22 Services to address an agricultural emergency when declared by
23 the Commissioner of Agriculture pursuant to s. 570.07.
24 Section 2. This act shall take effect July 1 of the
25 year in which enacted, if legislation creating the
26 Agricultural Emergency Eradication Trust Fund is adopted in
27 the same legislative session or an extension thereof.
