  1                      A bill to be entitled

  2         An act relating to the powers and duties of the

  3         Governor; amending s. 14.23, F.S.; regulating

  4         the nomination of appointees to federal

  5         regional fisheries management councils;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (4) is added to section 14.23,

11  Florida Statutes, to read:

12         14.23  State-Federal relations.--

13         (4)(a)  NOMINATIONS TO FEDERAL REGIONAL FISHERIES

14  MANAGEMENT COUNCILS.--The Governor is prohibited from

15  nominating for appointment to any one of the federal fisheries

16  management councils established under 16 U.S.C. s. 1801, et

17  seq, as amended, the name of any person who is, or who has

18  been at any time during the 24 months preceding such

19  nomination, a lobbyist for or paid employee of any entity of

20  any kind whatsoever whose interests are or could be affected

21  by actions or decisions of such fisheries management councils.

22         (b)  For purposes of this section, the term "lobbyist"

23  means any natural person who, for compensation, seeks, or

24  sought during the preceding 24 months, to influence the

25  governmental decisionmaking of a reporting individual or

26  procurement employee, as those terms are defined under s.

27  112.3148, or his or her agency, or who seeks, or sought during

28  the preceding 24 months, to encourage the passage, defeat, or

29  modification of any proposal or recommendation by such

30  reporting individual or procurement employee or his or her

31  agency.

  1         Section 2.  This act shall take effect January 1, 1999.
