18 Section 1. Subsection (7) is added to section 481.303,
19 Florida Statutes, to read:
20 481.303 Definitions.--As used in this chapter:
21 (7) "Landscape design" means consultation for and
22 preparation of planting plan drawings for compensation,
23 including specifications and installation details for plant
24 materials, soil amendments, mulches, edging, gravel, and other
25 similar materials, and xeriscape design, and includes
26 recommendation of the conceptual placement of tangible objects
27 and other elements for landscape design projects, provided
28 that construction documentation for such tangible objects
29 shall be designed or approved by appropriately licensed design
30 professionals, as required by law.
31 Section 2. Subsection (10) is added to section

2 481.329 Exceptions; exemptions from licensure.--
3 (10) Nothing in this part prohibits any person from
4 engaging in the practice of landscape design, as defined in s.
5 481.303(7), provided such person has been issued a certificate
6 of qualification to engage in such practice as specified in s.
7 481.333.
8 Section 3. Section 481.333, Florida Statutes, is
9 created to read:
10 481.333 Landscape design; certificate of qualification
11 required.--
12 (1) A person desiring to practice under the exemption
13 from licensure and regulation provided in s. 481.329(10) may
14 engage in landscape design only if the person meets one of the
15 following criteria and has been issued a certificate
16 acknowledging such qualification as provided in subsection
17 (2):
18 (a) Completion of a bachelor's degree in ornamental
19 horticulture, landscape design and management, or a related
20 field from an accredited college or university;
21 (b) Completion of an associate in science or an
22 associate in arts degree in landscape design, horticulture,
23 landscape management, or a related field from an accredited
24 community college, together with 2 years' full-time documented
25 experience in landscape design;
26 (c) Completion of a 1-year certificate in ornamental
27 horticulture, landscape management, or a related field from an
28 accredited technical center, together with 4 years' full-time
29 documented experience in landscape design;
30 (d) Completion of 6 years' full-time practical
31 experience in landscape design; however, qualification under

1 this paragraph is available only to persons who have the
2 requisite experience as of the effective date of this section;
3 or
4 (e) Certification by a nationally recognized
5 organization in landscape design.
6 (2) Any person who desires to engage in the practice
7 of landscape design in this state pursuant to the exemption
8 from licensure and regulation provided in s. 481.329(10) must
9 apply to the department for a certificate of qualification
10 under this section and must submit with such application proof
11 of meeting one of the criteria required under subsection (1).
12 Upon receipt of the application, the department shall issue to
13 any applicant submitting such application and proof a
14 certificate acknowledging qualification to engage in the
15 practice of landscape design without the necessity of
16 licensure or regulation as a landscape architect under this
17 part. The department may charge a one-time fee for the
18 issuance of the certificate, not to exceed $100.
19 (3) The department may adopt such rules as are
20 necessary to administer the provisions of this section.
21 Section 4. This act shall take effect October 1 of the
22 year in which enacted.
