  2         An act relating to landscape design; amending

  3         s. 481.303, F.S.; providing definitions;

  4         amending s. 481.329, F.S., providing exemptions

  5         from licensure and regulation under part II,

  6         ch. 489, F.S.; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (7) is added to section 481.303,

11  Florida Statutes, to read:

12         481.303  Definitions.--As used in this chapter:

13         (7)  "Landscape design" means consultation for and

14  preparation of planting plan drawn for compensation, including

15  specifications and installation details for plant materials,

16  soil amendments, mulches, edging, gravel, and other similar

17  materials. Such plans may include only recommendations for the

18  conceptual placement of tangible objects for landscape design

19  projects.  Construction documents, details, and specifications

20  for tangible objects and irrigation systems shall be designed

21  or approved by licensed professionals as required by law.

22         Section 2.  Subsection (5) of section 481.329, Florida

23  Statutes, is amended to read:

24         481.329  Exceptions; exemptions from licensure.--

25         (5)  Nothing in this part prohibits any person from

26  engaging in the practice of landscape design, as defined in s.

27  481.303(7).  This part shall not be deemed to prohibit any

28  nurseryman, nursery stock dealer, or agent as defined by

29  chapter 581 who is required under chapter 581 to hold a valid

30  license issued by the Division of Plant Industry of the

31  Department of Agriculture and Consumer Services and who does

  1  hold a valid license to engage in the business of selling

  2  nursery stock in this state, insofar as he engages in the

  3  preparation of plans or drawings as an adjunct to

  4  merchandising his product, so long as he does not  Persons

  5  providing landscape design services shall not use the title,

  6  term or designation "landscape architect", "landscape

  7  architectural", "landscape architecture", "L.A.", "landscape

  8  engineering", or any description tending to convey the

  9  impression that he is a landscape architect unless he is

10  registered as provided in this part. or is exempt from

11  registration under the provisions of this part.

12         Section 3.  This act shall take effect October 1, 1998.
