  1                      A bill to be entitled

  2         An act relating to jails; amending s. 951.23,

  3         F.S., relating to county and municipal

  4         detention facilities; providing criminal

  5         penalties for repeatedly, knowingly, and

  6         willfully refusing to obey certain rules and

  7         regulations while a prisoner in any such

  8         facility; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (11) is added to section 951.23,

13  Florida Statutes, to read:

14         951.23  County and municipal detention facilities;

15  definitions; administration; standards and requirements.--

16         (11) Any prisoner in any county or municipal detention

17  facility who repeatedly, knowingly, and willfully refuses to

18  obey any rule or regulation governing the conduct of prisoners

19  as provided for in the model standards, pursuant to subsection

20  (4), while being subject thereto, commits a misdemeanor of the

21  second degree, punishable as provided in s. 775.082 or s.

22  775.083. Such punishment must be in addition to the sentence

23  he or she is then serving.

24         Section 2.  This act shall take effect upon becoming a

25  law.
