4 determining the annual allocation to each
5 school district for operation of schools;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Paragraph (d) of subsection (1) of section
11 236.081, Florida Statutes, 1996 Supplement, is amended to
12 read:
13 236.081 Funds for operation of schools.--If the annual
14 allocation from the Florida Education Finance Program to each
15 district for operation of schools is not determined in the
16 annual appropriations act or the substantive bill implementing
17 the annual appropriations act, it shall be determined as
18 follows:
19 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
20 OPERATION.--The following procedure shall be followed in
21 determining the annual allocation to each district for
22 operation:
23 (d) Annual allocation calculation.--
24 1. The Department of Education is authorized and
25 directed to review all district programs and enrollment
26 projections and calculate a maximum total weighted full-time
27 equivalent student enrollment for each district.
28 2. Maximum enrollments calculated by the department
29 shall be derived from enrollment estimates used by the
30 Legislature to calculate the FEFP. If two or more districts
31 enter into an agreement under the provisions of s.

1 230.23(4)(d), after the final enrollment estimate is agreed
2 upon, the amount of FTE specified in the agreement, not to
3 exceed the estimate for the specific program as identified in
4 paragraph (c), may be transferred from the participating
5 districts to the district providing the program.
6 3. As part of its calculation of each district's
7 maximum total weighted full-time equivalent student
8 enrollment, the department shall establish separate enrollment
9 ceilings for each of three program groups. Group 1 shall be
10 composed of grades K-3, grades 4-8, and grades 9-12. Group 2
11 shall be composed of students-at-risk programs, all basic
12 programs other than the programs in group 1, all exceptional
13 child programs, and all vocational programs in grades 7-12.
14 Group 3 shall be composed of all adult education programs.
15 a. For any calculation of the FEFP, the weighted
16 enrollment ceiling for group 1 shall be calculated by
17 multiplying the actual enrollment for each program in the
18 program group by its appropriate program weight.
19 b.a. The initial weighted enrollment ceiling for group
20 2 and group 3 programs shall be calculated by multiplying the
21 final enrollment conference estimate for each program by the
22 appropriate program weight. The initial weighted enrollment
23 ceiling for program groups 2 and 3 shall be the sum of the
24 weighted enrollment ceilings for each program in the program
25 group, plus the increase in weighted full-time equivalent
26 student membership from the prior year for clients of the
27 Department of Health and Rehabilitative Services. However,
28 the initial weighted enrollment ceilings for group 2 and group
29 3 programs shall be adjusted as follows:
30 (I) If for any district, the initial group 2 or group
31 3 weighted enrollment ceiling exceeds actual weighted

1 enrollment, that surplus shall be redistributed among eligible
2 districts for which actual weighted enrollment exceeds the
3 initial weighted enrollment ceiling for the group. The
4 redistribution shall be based upon the excess actual weighted
5 enrollment for each eligible district as a percentage of all
6 eligible districts, increasing each eligible district's
7 adjusted weighted enrollment ceiling by the amount of the
8 redistribution.
9 (II) If, after any increase to a district's group 2
10 initial weighted enrollment ceiling which results from the
11 redistribution in sub-sub-subparagraph (I), that district's
12 actual weighted enrollment still exceeds the adjusted weighted
13 enrollment ceiling for group 2, then the district's group 2
14 adjusted weighted enrollment ceiling shall be increased by the
15 net of:
16 (A) For all group 2 programs for which actual
17 enrollment exceeds estimated enrollment, the total excess
18 times a cost factor of 1.0, less
19 (B) For all group 2 programs for which estimated
20 enrollment exceeds actual enrollment, the total excess times a
21 cost factor of 1.0.
22 c.b. If, for any calculation of the FEFP, the weighted
23 enrollment for either program group 2 or group 3, derived by
24 multiplying actual enrollments by appropriate program weights,
25 exceeds the adjusted enrollment ceiling for that group, the
26 following procedure shall be followed to reduce the weighted
27 enrollment for that group to equal the adjusted enrollment
28 ceiling:
29 (I) The adjusted weighted enrollment ceiling for each
30 program in the program group shall be subtracted from the

1 weighted enrollment for that program derived from actual
2 enrollments.
3 (II) If the difference calculated under
4 sub-sub-subparagraph (I) is greater than zero for any program,
5 a reduction proportion shall be computed for the program by
6 dividing the absolute value of the difference by the total
7 amount by which the weighted enrollment for the program group
8 exceeds the adjusted weighted enrollment ceiling for the
9 program group.
10 (III) The reduction proportion calculated under
11 sub-sub-subparagraph (II) shall be multiplied by the total
12 amount of the program group's enrollment over the adjusted
13 ceiling as calculated under sub-sub-subparagraph (I).
14 (IV) The prorated reduction amount calculated under
15 sub-sub-subparagraph (III) shall be subtracted from the
16 program's weighted enrollment. For any calculation of the
17 FEFP, the enrollment ceiling for group 1 shall be calculated
18 by multiplying the actual enrollment for each program in the
19 program group by its appropriate program weight.
20 d.c. For program groups 2 and 3, the adjusted weighted
21 enrollment ceiling shall be a number not less than the sum
22 obtained by:
23 (I) Multiplying the sum of reported FTE for all
24 programs in the program group that have a cost factor of 1.0
25 or more by 1.0, and
26 (II) By adding this number to the sum obtained by
27 multiplying the projected FTE for all programs with a cost
28 factor less than 1.0 by the actual cost factor.
29 Section 2. This act shall take effect July 1, 1997.
