2 An act relating to personal injury protection
3 insurance; amending s. 627.736, F.S.;
4 decreasing certain required reporting times for
5 certain actions; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Paragraph (a) of subsection (9) of section
10 627.736, Florida Statutes, 1996 Supplement, is amended to
11 read:
12 627.736 Required personal injury protection benefits;
13 exclusions; priority.--
14 (9)(a) Each insurer which has issued a policy
15 providing personal injury protection benefits shall report the
16 renewal, cancellation, or nonrenewal thereof to the Department
17 of Highway Safety and Motor Vehicles within 14 45 days from
18 the effective date of the renewal, cancellation, or
19 nonrenewal. Upon the issuance of a policy providing personal
20 injury protection benefits to a named insured not previously
21 insured by the insurer thereof during that calendar year, the
22 insurer shall report the issuance of the new policy to the
23 Department of Highway Safety and Motor Vehicles within 14 30
24 days. The report shall be in such form and format and contain
25 such information as may be required by the Department of
26 Highway Safety and Motor Vehicles which shall include a format
27 compatible with the data processing capabilities of said
28 department, and the Department of Highway Safety and Motor
29 Vehicles is authorized to adopt rules necessary with respect
30 thereto. Failure by an insurer to file proper reports with the
31 Department of Highway Safety and Motor Vehicles as required by

1 this subsection or rules adopted with respect to the
2 requirements of this subsection constitutes a violation of the
3 Florida Insurance Code. Reports of cancellations and policy
4 renewals and reports of the issuance of new policies received
5 by the Department of Highway Safety and Motor Vehicles are
6 confidential and exempt from the provisions of s. 119.07(1).
7 These records are to be used for enforcement and regulatory
8 purposes only, including the generation by the department of
9 data regarding compliance by owners of motor vehicles with
10 financial responsibility coverage requirements. In addition,
11 the Department of Highway Safety and Motor Vehicles shall
12 release, upon a written request by a person involved in a
13 motor vehicle accident, by the person's attorney, or by a
14 representative of the person's motor vehicle insurer, the name
15 of the insurance company and the policy number for the policy
16 covering the vehicle named by the requesting party. The
17 written request must include a copy of the appropriate
18 accident form as provided in s. 316.065, s. 316.066, or s.
19 316.068.
20 Section 2. This act shall take effect October 1, 1997.

25 reporting to the Department of Highway Safety and Motor
Vehicles renewals, cancellations, or nonrenewals of
26 policies providing personal protection benefits and from
30 days to 14 days the required time to report the
27 issuance of new policies providing such benefits. See
