2 An act relating to employee organizations;
3 amending s. 447.303, F.S.; limiting deductions
4 by employers of dues of certain employee
5 organizations under certain circumstances;
6 providing exceptions; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 447.303, Florida Statutes, is
12 amended to read:
13 447.303 Dues; deduction and collection.--Any employee
14 organization which has been certified as a bargaining agent
15 shall have the right to have its dues and uniform assessments
16 deducted and collected by the employer from the salaries of
17 those employees who authorize the deduction of said dues and
18 uniform assessments. However, such authorization is revocable
19 at the employee's request upon 30 days' written notice to the
20 employer and employee organization. Said deductions shall
21 commence upon the bargaining agent's written request to the
22 employer. The employer shall not grant a dues deduction to
23 any other employee organization, except a religious
24 institution or qualified charitable institution under s.
25 501(c)(3) of the United States Internal Revenue Code of 1986,
26 as amended, provided such institutions do not represent, or
27 attempt to represent, bargaining unit members in terms and
28 conditions of employment. Reasonable costs to the employer of
29 said deductions shall be a proper subject of collective
30 bargaining. Such right to deduction, unless revoked pursuant
31 to s. 447.507, shall be in force for so long as the employee

1 organization remains the certified bargaining agent for the
2 employees in the unit. The public employer is expressly
3 prohibited from any involvement in the collection of fines,
4 penalties, or special assessments.
5 Section 2. This act shall take effect October 1 of the
6 year in which enacted.
