1 A bill to be entitled
2 An act relating to pesticide spraying;
3 prohibiting aerial application of certain
4 substances for certain purposes; providing a
5 penalty; requiring certain legislative
6 committees and the Department of Agriculture
7 and Consumer Services to conduct workshops for
8 certain purposes; requiring a report; providing
9 an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Until July 1, 1999, it is unlawful for any
14 person to apply any pesticide or other poisonous or toxic
15 substance from an airplane, helicopter, glider, or other
16 aircraft, or lighter-than-air craft, for purposes of
17 controlling or eradicating insects. Any person who applies any
18 pesticide or other poisonous or toxic substance from an
19 airplane, helicopter, glider, or other aircraft, or
20 lighter-than-air craft, in violation of this section commits a
21 misdemeanor of the first degree, punishable as provided in s.
22 775.082 or s. 775.083, Florida Statutes.
23 Section 2. The Agriculture Committees of the Senate
24 and the House of Representatives shall conduct a series of
25 workshops with the Department of Agriculture and Consumer
26 Services and any other appropriate public or private agency
27 involved in regulating or otherwise monitoring or overseeing
28 the application of pesticides or other poisonous or toxic
29 substances to control or eradicate insects to develop
30 alternative procedures and methodologies for application of
31 pesticides or other poisonous or toxic substances to control

1 or eradicate insects. The workshops shall consider procedures
2 for scheduling aerial application of pesticides or other
3 poisonous or toxic substances, including, but not limited to,
4 minimum requirements for advance notification of residents of
5 any area over which pesticides or other poisonous or toxic
6 substances are to be aerially applied, the impacts of aerial
7 application over water or residential, urban, agricultural,
8 commercial, or industrial areas, methodologies for mitigation
9 of adverse impacts of aerial applications, and alternatives to
10 aerial application. On or before January 1, 1999, the
11 department shall prepare and submit a report to the Governor,
12 the President of the Senate, and the Speaker of the House of
13 Representatives describing the results of such workshops and
14 proposing recommendations to regulate the application of
15 pesticides or other poisonous or toxic substances to control
16 or eradicate insects.
17 Section 3. This act shall take effect upon becoming a
18 law.
