1 A bill to be entitled
2 An act relating to public officers and
3 employees; amending s. 99.012, F.S.; requiring
4 public officers and employees to take a leave
5 of absence without pay during the period of
6 their candidacy for public office; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (5) of section 99.012, Florida
12 Statutes, is amended to read:
13 99.012 Restrictions on individuals qualifying for
14 public office.--
15 (5) A person who is a subordinate officer, deputy
16 sheriff, or police officer need not resign pursuant to this
17 section unless the person is seeking to qualify for a public
18 office which is currently held by an officer who has authority
19 to appoint, employ, promote, or otherwise supervise that
20 person and who has qualified as a candidate for reelection to
21 that office. However, upon qualifying, a the subordinate
22 officer, deputy sheriff, or police officer must take a leave
23 of absence without pay during the period in which he or she is
24 a candidate for office, whether or not the subordinate
25 officer, deputy sheriff, or police officer is required to
26 resign under this section.
27 Section 2. This act shall take effect upon becoming a
28 law.
