  1                      A bill to be entitled

  2         An act relating to premium finance agreements;

  3         amending s. 627.841, F.S., providing that any

  4         installment paid to a premium finance company

  5         under a premium finance agreement shall be

  6         deemed to be a timely payment if it is received

  7         with a postmark on or before the due date;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (5) is added to s. 627.841,

13  Florida Statutes, to read:

14         627.841  Delinquency, collection, cancellation, and

15  check return charges; attorney's fees.--

16         (5)  Any installment postmarked on or before the due

17  date shall be deemed a timely payment.

18         Section 2.  This act shall take effect October 1, 1997,

19  and shall apply to premium finance agreements entered into on

20  or after that date.
