  1                      A bill to be entitled

  2         An act relating to the City of Jacksonville,

  3         amending chapter 92-341, Laws of Florida, as

  4         amended; amending the Charter of the City of

  5         Jacksonville, providing that the mayor's veto

  6         power shall not apply to zoning variances and

  7         quasi-judicial decisions by the city council;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Section 6.05 of chapter 92-341, Laws of

13  Florida, is amended to read:

14                       ARTICLE 6. THE MAYOR

15         Section 6.05.  Mayor's veto power.--The mayor may veto

16  any ordinance or resolution adopted by the council except

17  ordinances and resolutions relating to:

18         (a)  Consolidation of the urban services districts.

19         (b)  Appointments to the zoning board and the building

20  codes adjustment board.

21         (c)  Zoning exceptions and variances.

22         (d)  The auditor, the secretary of the council, or

23  other employees of the council.

24         (e)  Internal affairs of the council.

25         (f)  Investigations by the council or any duly

26  appointed committee thereof.

27         (g)  Quasi-judicial decisions made by the council.

29  Any ordinance or resolution adopted by the council over which

30  the mayor has a veto power shall be presented to the mayor for

31  his consideration and recommendations.  If he approves the

  1  ordinance or resolution he shall sign it and it shall become

  2  effective according to the terms thereof.  If he disapproves

  3  he shall return the ordinance or resolution to the council

  4  without his signature, accompanied by a message indicating the

  5  reasons for his disapproval and recommendations.  Any

  6  resolution or ordinance so disapproved by the mayor shall

  7  become effective only if, subsequent to its return, it shall

  8  be adopted by two-thirds of all the members of the council

  9  present at any meeting; except that if the mayor vetoes any

10  item in the consolidated budget appropriation, only a majority

11  vote of the members of the council shall be required to adopt

12  the same as law over the mayor's veto. Any resolution or

13  ordinance shall become effective on the date provided therein

14  unless it be disapproved by the mayor and returned to the

15  council at or prior to the next regular meeting of the council

16  occurring 10 days or more after the date when the ordinance or

17  resolution was delivered to the mayor's office for

18  consideration.  The mayor may disapprove the sum of money

19  appropriated by any one or more items, or parts of items, in

20  any ordinance appropriating money for the use of the

21  consolidated government or any independent agency, in any

22  manner provided herein.  The one or more items or parts of

23  items disapproved or reduced shall be void to the extent that

24  they have been disapproved or reduced, unless they shall be

25  restored to the ordinance and become effective by the vote of

26  a majority of the members of the council.

27         Section 2.  This act shall take effect upon becoming a

28  law.
