  1                      A bill to be entitled

  2         An act relating to state funds; amending s.

  3         370.12, F.S.; providing a condition under which

  4         the annual allocation of funds to the Save the

  5         Manatee Trust Fund shall be reduced; providing

  6         specified restrictions on the expenditure of

  7         state funds; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Paragraph (d) of subsection (5) of section

12  370.12, Florida Statutes, is amended to read:

13         370.12  Marine animals; regulation.--

14         (5)  ANNUAL FUNDING OF PROGRAMS FOR MARINE ANIMALS.--

15         (d)  When the federal and state governments remove the

16  manatee from status as an endangered or threatened species,

17  the annual allocation may be reduced. When the number of

18  living manatees exceeds the number of manatees that existed

19  during the periods both 10 years and 100 years previously, the

20  annual allocation shall be reduced.

21         Section 2.  No state funds may be expended or utilized

22  in any manner by any private organization for the payment of

23  any legal fees incurred as the result of a challenge to, or

24  opposition of, any rule, regulation, or statute lawfully

25  adopted by the State of Florida or any agency or

26  instrumentality thereof.  No state funds may be expended or

27  utilized in any manner by any private organization for the

28  payment of any legal fees in any action which would result in

29  the dilution, inordinate burden, restriction, or limitation of

30  private property rights of any landowner within the State of

31  Florida. Any private organization receiving state funds which

  1  expends or utilizes in any manner such funds for the payment

  2  of any legal fees incurred as the result of a challenge to, or

  3  opposition of, any rule or regulation of the Florida

  4  Department of Environmental Protection shall be prohibited

  5  from further receipt of state funds.

  6         Section 3.  This act shall take effect upon becoming a

  7  law.
