  1                      A bill to be entitled

  2         An act relating to culpable negligence;

  3         prohibiting a person who has been entrusted

  4         with the care and custody of state assets from

  5         causing losses of the assets in excess of

  6         $100,000 through culpable negligence; providing

  7         penalties; requiring that notice of specified

  8         provisions relating to the crime of culpable

  9         negligence causing public financial injury be

10         included in a state contract with another

11         person or corporation in excess of $50,000;

12         providing that failure to provide the notice

13         does not constitute a defense to the crime;

14         providing an effective date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  Culpable negligence causing public

19  financial injury.--

20         (1)  Any person who, having been entrusted by the state

21  with the care and custody of state assets, causes losses of

22  the assets in excess of $100,000 through culpable negligence

23  commits the offense of culpable negligence causing public

24  financial injury, a felony of the third degree, punishable as

25  provided in s. 775.082, s. 775.083, or s. 775.084, Florida

26  Statutes.

27         (2)  Any state contract with another person or

28  corporation in excess of $50,000 shall include notice of the

29  provisions of subsection (1). Failure to provide this notice

30  shall not constitute a defense to the crime of culpable

31  negligence causing public financial injury.

  1         Section 2.  This act shall take effect July 1 of the

  2  year in which enacted.
