11  The Committee on Finance & Taxation offered the following:

13         Amendment (with title amendment) 

14         On page 2, line 30 of the bill

15

16  insert:

17         Section 2. subsection (3) is added to Section 125.35,

18  Florida Statutes, to read:

19         (3)  In accordance with s. 13, Article X of the State

20  Constitution, a county may waive sovereign immunity and agree

21  to hold harmless and indemnify any party to a lease or

22  financing of real property or airport or seaport operation or

23  facility against damages to third parties and, notwithstanding

24  s.  768.28, up to such amount as determined by the governing

25  of such county where such damage has not resulted from the

26  gross negligence or willful misconduct of the indemnified

27  party.  The action authorized by this subsection is to be

28  limited to lease transactions which serve a paramount public

29  purpose as determined by the county.
