17  and insert in lieu thereof:

18  (5)  No person shall construct or operate a transfer facility

19  for the management of hazardous waste unless the facility

20  meets the siting requirements of subsection (2).

21         (6)  This section shall not prohibit the operation of

22  existing transfer facilities that have commenced operation as

23  of the effective date of this section, if the transfer

24  facility is not relocated or if there is no substantial

25  modification in the structure or operation of the facility

26  after the effective date of this section.
