17 Section 1. Section 810.14, Florida Statutes, is
18 created to read:
19 810.14 Voyeurism prohibited; penalties.--
20 (1) A person commits the offense of voyeurism when he
21 or she, with lewd, lascivious, or indecent intent, secretly
22 observes, photographs, films, videotapes, or records another
23 person when such other person is located in a dwelling,
24 structure, or conveyance and such location provides a
25 reasonable expectation of privacy.
26 (2) A person may be convicted of and sentenced
27 separately for a violation of this section and for any other
28 criminal offense, including, but not limited to, burglary,
29 trespass, or loitering.
30 (3) A person who violates this section commits:
31 (a) A misdemeanor of the first degree for the first

1 violation, punishable as provided in s. 775.082 or s. 775.083.
2 (b) A felony of the third degree for a second or
3 subsequent violation, punishable as provided in s. 775.082, s.
4 775.083, or s. 775.084.
5 Section 2. This act shall take effect July 1 of the
6 year in which enacted.

10 And the title is amended as follows:
11 remove from the title of the bill: lines 4 through 16

13 and insert in lieu thereof:
14 voyeurism; prohibiting a person, with lewd,
15 lascivious, or indecent intent, from secretly
16 observing, photographing, filming, videotaping,
17 or recording another person located in a
18 dwelling, structure, or conveyance providing a
19 reasonable expectation of privacy; providing
20 for conviction and sentencing of the offense
21 separately from other offenses; providing
22 penalties; providing third degree felony
23 penalties upon conviction of a second or
24 subsequent offense of voyeurism; providing an
25 effective date.
