1 A bill to be entitled
2 An act relating to voyeurism; creating s.
3 810.14, F.S., relating to the offense of
4 voyeurism; prohibiting a person, with lewd,
5 lascivious, or indecent intent, from secretly
6 observing, photographing, filming, videotaping,
7 or recording another person located in a
8 dwelling, structure, or conveyance providing a
9 reasonable expectation of privacy; providing
10 for conviction and sentencing of the offense
11 separately from other offenses; providing
12 penalties; providing third degree felony
13 penalties upon conviction of a second or
14 subsequent offense of voyeurism; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Section 810.14, Florida Statutes, is
20 created to read:
21 810.14 Voyeurism prohibited; penalties.--
22 (1) A person commits the offense of voyeurism when he
23 or she, with lewd, lascivious, or indecent intent, secretly
24 observes, photographs, films, videotapes, or records another
25 person when such other person is located in a dwelling,
26 structure, or conveyance and such location provides a
27 reasonable expectation of privacy.
28 (2) A person may be convicted of and sentenced
29 separately for a violation of this section and for any other
30 criminal offense, including, but not limited to, burglary,
31 trespass, or loitering.

1 (3) A person who violates this section commits:
2 (a) A misdemeanor of the first degree for the first
3 violation, punishable as provided in s. 775.082 or s. 775.083.
4 (b) A felony of the third degree for a second or
5 subsequent violation, punishable as provided in s. 775.082, s.
6 775.083, or s. 775.084.
7 Section 2. This act shall take effect July 1 of the
8 year in which enacted.
