1 A bill to be entitled
2 An act relating to water and wastewater
3 utilities; amending s. 367.081, F.S.; requiring
4 the Public Service Commission to extend time
5 periods and reschedule events by the number of
6 days a utility is late in providing discovery;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (9) is added to section 367.081,
12 Florida Statutes, to read:
13 367.081 Rates; procedure for fixing and changing.--
14 (9) If a utility fails to comply fully with valid
15 requests for discovery within 3 days after the due date for
16 the discovery, the commission shall extend all time periods
17 otherwise provided in this section by at least the same number
18 of days by which the discovery was provided late, and the
19 commission shall similarly reschedule all events recognized by
20 the commission by at least the same number of days by which
21 the discovery was provided late, including, but not limited
22 to, prehearing conferences, deadlines for filing testimony,
23 hearing dates, discovery due dates, and the periods for
24 withholding consent to rate requests. In addition to the time
25 extension caused by the delay, the commission shall have 120
26 days to hold the final hearing.
27 Section 2. This act shall take effect upon becoming a
28 law.

3 Requires the Public Service Commission to extend time
