15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. The North Bay Fire Control District is
18 recreated and reenacted to read:
19 Section 1. Creation and intent.--Upon this act
20 becoming law, the North Bay Fire Control District, formerly
21 known as the Seminole Fire District, shall be recreated as an
22 independent fire control district which shall operate pursuant
23 to this special act and the provisions of chapter 191, Florida
24 Statutes, the Independent Special Fire Control District Act,
25 as it may be amended from time to time, and all other general
26 law applicable to independent special districts. It is the
27 intent of this act to preserve all existing district authority
28 as it may be modified pursuant to the provisions of chapter
29 191, Florida Statutes, including the authority to annually
30 assess and levy against the taxable property in the district a
31 tax not to exceed 2 mills on the dollar of assessed valuation.

1 Section 2. Boundaries.--The following area in Okaloosa
2 County shall be established as the independent fire control
3 district known as the North Bay Fire Control District:
4 That land area lying in Township 1 South, Range
5 22 West, bounded on the north by Rocky Bayou
6 and Eglin Air Force Base Reservation, bounded
7 on the west and south by Choctawhatchee Bay and
8 bounded on the east by the Walton County line
9 and Eglin Air Force Base Reservation.
10 Section 3. Taxing authority.--
11 (1) The board of fire commissioners is hereby
12 authorized to levy and impose an ad valorem tax for fire
13 protection services provided by the district in an amount not
14 in excess of 2 mills on the dollar against the nonexempt
15 assessed value of property in the district as previously
16 approved by referendum vote of the electors of the district.
17 (2) The aforementioned ad valorem taxes shall be
18 levied and imposed by the board of fire commissioners pursuant
19 to the provisions of chapter 191, Florida Statutes, and shall
20 be assessed, levied, and collected in the same manner as
21 county taxes.
22 Section 4. Construction.--The provisions of this act
23 shall be liberally construed in order to effectively carry out
24 the purposes of this act in the interest of the public health,
25 welfare, and safety of the citizens served by the district.
26 Section 2. It is declared to be the intent of the
27 Legislature that if any section, subsection, sentence, clause,
28 phrase, or portion of this act is for any reason held invalid
29 or unconstitutional by any court of competent jurisdiction,
30 such portion shall be deemed a separate, distinct, and

1 independent provision, and such holding shall not effect the
2 validity of the remaining portions hereof.
3 Section 3. This act shall take effect upon becoming a
4 law.
