  1                      A bill to be entitled

  2         An act relating to solid waste management;

  3         amending s. 403.7045, F.S.; authorizing the

  4         Department of Environmental Protection to allow

  5         recycling and reuse of ash residue which meets

  6         department standards adopted by rule; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (5) of section 403.7045, Florida

12  Statutes, is amended to read:

13         403.7045  Application of act and integration with other

14  acts.--

15         (5)  Ash residue generated by a solid waste management

16  facility from the burning of solid waste must shall be

17  disposed of in a properly designed solid waste disposal area

18  that complies with standards developed by the department for

19  the disposal of such ash residue. Rulemaking shall be

20  initiated and at least one public hearing held by February 1,

21  1989.  The department shall work with solid waste management

22  facilities that which burn solid waste to identify and develop

23  methods for recycling and reuse of incinerator ash residue or

24  treated ash residue, and the department may allow such

25  recycling or reuse by an applicant who demonstrates that no

26  significant threat to public health will result and that

27  applicable department standards and criteria will not be

28  violated. The Division of Waste Management shall direct the

29  district offices and bureaus on matters relating to the

30  interpretation and applicability of this subsection. The

31  department may adopt rules necessary for administering this

  1  subsection, but the department is not required to amend its

  2  existing rules.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
