  1                      A bill to be entitled

  2         An act relating to motor vehicle emissions

  3         inspections; directing the Department of

  4         Highway Safety and Motor Vehicles to hire an

  5         independent expert consultant to do a study;

  6         prohibiting the department from entering into a

  7         contract for a motor vehicle inspection

  8         program; amending s. 325.214, F.S.; setting the

  9         fee for inspections; establishing funds for the

10         study; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  The Department of Highway Safety and Motor

15  Vehicles shall hire an independent expert consultant to

16  develop appropriate request-for-proposal specifications and a

17  range of inspection fees for the motor vehicle emissions

18  inspection program based on an annual and a biennial

19  inspection program for vehicles 4 model years old and older,

20  using the basic test for hydrocarbon emissions and carbon

21  monoxide emissions and other mobile source testing for nitrous

22  oxides or other pollutants, and no later than January 1, 1999,

23  to report to the President of the Senate and the Speaker of

24  the House of Representatives setting forth the relevant facts

25  and the department's recommendations. Notwithstanding the

26  provisions of chapter 325, Florida Statutes, the department

27  and the Governor and Cabinet, acting as head of that agency,

28  are prohibited from entering into any contract or extension of

29  a contract for any form of motor-vehicles-emissions testing

30  without legislative approval through the enactment of specific

  1  legislation directing the department to implement an

  2  inspection program and establishing a fee for the program.

  3         Section 2.  Subsection (2) of section 325.214, Florida

  4  Statutes, is amended to read:

  5         325.214  Motor vehicle inspection; fees; disposition of

  6  fees.--

  7         (2)  The department shall set an inspection fee shall

  8  be not to exceed $10. By rule, the department shall set a

  9  regulatory amount to be included in the fee which is

10  commensurate with the cost of administering and enforcing the

11  inspection program.  It is the intent of the Legislature that

12  the program be self-supporting.  Notwithstanding any other

13  provision of law to the contrary, an additional fee of $1

14  shall be assessed upon the issuance of each dealer

15  certificate, which fee shall be forwarded to the department

16  for deposit into the Highway Safety Operating Trust Fund.

17         Section 3.  There is appropriated from the Department

18  of Highway Safety Operating Trust Fund of the Department of

19  Highway Safety and Motor Vehicles for fiscal year 1998-1999,

20  the sum of $125,000 to fund the study established in this act.

21         Section 4.  This act shall take effect upon becoming a

22  law.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                          CS for SB 374

  3

  4  This committee substitute makes the following provisions:

  5  Directs the Department of Highway Safety and Motor Vehicles to
    hire an independent consultant to develop appropriate
  6  request-for-proposal specifications and a range of inspection
    fees for an annual and a biennial motor-vehicle-emissions
  7  testing program for vehicles 4 model years old and older.

  8  Requires the department to report the relevant facts and its
    recommendations to the President of the Senate and the Speaker
  9  of the House of Representatives by January 1, 1999.

10  Appropriates $125,000 for fiscal year 1998-1999 from the
    Department of Highway Safety Operating Trust Fund of the
11  Department of Highway Safety and Motor Vehicles to fund this
    study.
