13         Amendment to Amendment (403741) (with title amendment) 

14         On page 40, between lines 11 and 12 of the amendment

15

16  insert:

17         Section 39.    Section 16 of Chapter 97-13, Laws of

18  Florida is hereby amended to read:

19         Section 16.  Effective January 1, 1999, Subsection (4)

20  of section 106.141, Florida Statutes, is amended to read:

21         106.141  Disposition of surplus funds by candidates.--

22         (4)(a)  Except as provided in paragraph (b), any

23  candidate required to dispose of funds pursuant to this

24  section shall, at the option of the candidate, dispose of such

25  funds by any of the following means, or any combination

26  thereof:

27         1.  Return pro rata to each contributor the funds that

28  have not been spent or obligated.

29         2.  Donate the funds that have not been spent or

30  obligated to a charitable organization or organizations that

31  meet the qualifications of s. 501(c)(3) of the Internal

 1  Revenue Code.

 2         3.  Give not more than $10,000 of the funds that have

 3  not been spent or obligated to the political party of which

 4  such candidate is a member.

 5         4.  Give the funds that have not been spent or

 6  obligated:

 7         a.  In the case of a candidate for state office, to the

 8  state, to be deposited in either the Election Campaign

 9  Financing Trust Fund or the General Revenue Fund, as

10  designated by the candidate; or

11         b.  In the case of a candidate for an office of a

12  political subdivision, to such political subdivision, to be

13  deposited in the general fund thereof.

14         (b)  Any candidate required to dispose of funds

15  pursuant to this section who has received contributions from

16  the Election Campaign Financing Trust Fund shall return all

17  surplus campaign funds to the Election Campaign Financing

18  Trust Fund.

24  remove:  all of said lines

26  and insert in lieu thereof:

27         amending s. 16, Ch. 97-13, Laws of Florida,

28         which amends s. 106.141, F.S., relating to

29         disposition of surplus funds by candidates;

30         providing an effective date.
