17 and insert in lieu thereof:
18 (3) Notwithstanding subsections (1) and (2), unless
19 authorized by rule of the Marine Fisheries Commission, it is a
20 major violation under this section, punishable as provided in
21 subsection (4), for any person, firm, or corporation to
22 possess any gill or entangling net, or any seine net larger
23 than 500 square feet in mesh area, on any airboat or on any
24 other vessel less than 22 feet in length and on any vessel
25 less than 25 feet in length if primary power of the vessel is
26 mounted forward of the vessel center point. Gill or entangling
27 nets shall be as defined in s. 16, Art. X of the State
28 Constitution, s. 370.093(2)(b), or in a rule of the Marine
29 Fisheries Commission implementing s. 16, Art. X of the State
30 Constitution. Vessel length shall be determined in accordance
31 with current U.S. Coast Guard regulations specified in the

1 Code of Federal Regulations or as titled by the State of
2 Florida. The Marine Fisheries Commission may adjust by rule
3 the use of gear on vessels of lengths different than those
4 specified in this section in order to prevent the illegal use
5 of gill and entangling nets in state waters and to provide
6 reasonable opportunities for the use of legal net gear in
7 adjacent federal waters.
